Con la participación de 181 inscriptos continuó hoy la segunda jornada del Fuero de Familia 2020, este año, debido a la pandemia, en su versión virtual, a través de la plataforma Zoom.
El clásico encuentro que, anualmente, organiza la Asociación de la Magistratura y la Función Judicial de la Provincia de Entre Ríos, contó con la disertación del Dr. Ricardo Pérez Manrique, juez de la Corte Interamericana de Derechos Humanos, quien habló de: “La jurisprudencia de la Corte Interamericana de Derechos Humanos en materia de niños, niñas y adolescentes”. El debate de hoy estuvo coordinado por el Dr. Raúl Tomaselli, juez de Familia y Penal de NNYA N° 1 de Concordia, Entre Ríos.
En su exposición, Pérez Manrique, hizo un repaso de los fallos de la Corte Interamericana sobre el interés superior del niño, niña y adolescente; también habló del Caso Gelman y los nuevos conceptos de familia.
A la hora del debate, el expositor también abordó –ante una consulta– los derechos de familia en la actual situación generada por la pandemia y las restricciones de circulación y traslados que se establecieron en el marco de la emergencia sanitaria.
En ese sentido, recordó que el 9 de abril, la Corte Interamericana emitió una declaración respecto a la integración familiar en el marco de Covid 19. “La Corte dijo que los problemas y desafíos deben abordarse con perspectiva de derechos humanos respetando las obligaciones internacionales en el marco del estado de derecho. La Corte señaló que en situación de emergencia y de encierro se están perjudicando directamente a los sectores y habla de una protección en sus derechos sociales, económicos, culturales y ambientales. También dijo que los sectores de mayor vulnerabilidad son los niños, niñas y adolescentes, que, debido al aislamiento social, puede redundar en un aumento de la violencia hacia ellos en sus hogares, por lo que instó al Estado a actuar con diligencia en caso de violencia mediante la denuncia directa”, destacó Pérez Manrique.
Asimismo, consideró que los “jueces estamos obligados, aún en esta emergencia, a hacer un análisis desde el bloque constitucional y convencional y admitir si una restricción es legítima”, acotó.
Por otra parte, ante la consulta de si cree necesario la creación de Cámaras de Apelaciones y la especialización del Fuero de Familia en primera instancia, Pérez Manrique consideró que es necesario y recordó que “la Corte desarrolló el concepto de la interseccionalidad que es cuando confluyen, en una misma persona, varias vulnerabilidades. Por ejemplo: ¿un hijo pequeño de una mujer que está presa está siendo vulnerado por ser niño, porque su madre está presa o por el ambiente en el que vive? Hay una cantidad de factores que confluyen a aumentar su vulnerabilidad y, ante esto, la Corte ha dicho que se requiere de un sistema especializado, tanto en el marco normativo de fondo a través del Derecho Penal como en el normativo Procesal, con procedimientos especiales, como también en el juzgamiento con jueces o juezas especializadas, también en el plano de la Defensa, del Ministerio Público y, por supuesto, al momento de ejecutar las sanciones”.
Como conclusión, el magistrado planteó la necesidad de trabajar en la construcción de una Justicia especializada para el Fuero de Familia, así como existe en el de violencia por razones de género. “Tenemos que pensar en una Justicia de Familia, en sus diferentes estamentos especializada en primera y segunda instancia”.
Poco antes de finalizar la segunda jornada, el presidente del Superior Tribunal de Justicia, Dr. Martin Carbonell, hizo uso de la palabra para agradecer la presencia del Pérez Manrique y por compartir sus saberes.

Joaquín Uranga (Director de Gestión Humana, STJER), Dra. Huerto Ava (Psiquiatra, ETI Villaguay, Entre Ríos), Lic. Jorge Álvarez (Licenciado en Trabajo Social, Concordia, Entre Ríos), Lic. Gabriela Torregrosa, (Psicóloga ETIS, La Paz), Dra. Claudia Laferriere (Jueza de Familia de Paraná, Entre Ríos).
La presentación y moderación del encuentro estará a cargo del Dr. Juan Eduardo Lloveras (Juez de Familia y Penal de NNyA de Victoria, Entre Ríos).
