El lunes 20 de septiembre, por la tarde, se realizó el primer encuentro, con el que se dio inicio al Ciclo de Conferencia “Independencia: El Poder Judicial en su Encrucijada”, organizado por el Observatorio de Independencia Judicial que funciona dentro del ámbito de la Asociación de la Magistratura y la Función Judicial de Entre Ríos.
Bajo el título “El diálogo en los tribunales internacionales de derechos humanos sobre independencia judicial”, disertó la Dra. Marie-Christine Fuchs, abogada, Magister y Doctora en Derecho de la Universität des Saarlandes, Saarbrücken, Alemania.
La Dra. Fuchs expuso sobre la posición de la Corte Interamericana de Derechos Humanos (Corte IDH) y del Tribunal Europeo de Derechos Humanos (TEDH) en el combate a injerencias indebidas en el ejercicio de jueces y fiscales. Además, remarcó y explicó cómo la CIDH y el TEDH se han nutrido recíprocamente tomando los mismos criterios jurisprudenciales para dirimir conflictos de independencia judicial. A su vez, se expresó sobre la importancia que tiene este principio fundamental para el Estado de derecho.
En función de ello, la Dra. Fuchs, quien hasta el 31 de agosto pasado se desempeñó como Directora del Programa Estado de Derecho para América Latina, de la Fundación Konrad Adenauer, y actualmente es funcionaria del Ministerio de Justicia de la Federación Alemana, en Berlín, hizo mención a los casos recientes, tales como: Urrutia Laubreaux Vs. Chile, de agosto 2020, en donde el tribunal de la CIDH declaró responsable a Chile por la violación de la libertad de expresión y las garantías judiciales del juez Urrutia, sancionado disciplinariamente por un trabajo académico que había elaborado para un Diplomado en Derechos Humanos; Martínez Esquivia Vs. Colombia y Casa Nina vs. Perú, de octubre y noviembre de 2020 respectivamente, ambos sobre destitución de fiscales provisorios. También se refirió a los casos Kudeshkina vs. Rusia (2009), Baka vs. Hungría (2016), entre otros del TEDH.
La presentación estuvo a cargo de la Dra. Gabriela López Arango, presidenta de AMFJER, quien participó del encuentro y agradeció a los presentes y a la expositora. Felicitando a los miembros del Observatorio por la iniciativa, remarcó la importancia de impulsar jornadas y conferencias de gran interés e importancia en los tiempos que corren.
